As the ticket holder and/or car owner/car passenger, I expressly assume all risk and danger arising from or incidental to the event for which the ticket is issued, whether such risks occur prior to, during, or subsequent to the actual event. I expressly release Luftgekühlt, LLC, Patrick Long Motorsport, LLC, Pilot Culture, LLC and Patrick Long (individual), hereafter referred to as "Luftgekühlt 12", sponsors, partners, vendors, participants, performers, and car owners (collectively “management”) and all of their owners, officers, directors, employees, volunteers, contractors, representatives, and agents, from any and all claims (including those to physical personal property, including cars) that have or may have arisen from or are incidental to the event, including any claims arising out of the negligence of management or management’s owners, officers, directors, employees, contractors, representatives or agents.

NOTICE OF NO LIABILITY WITH WAIVER AND RELEASE AND INDEMNIFICATION:

This shall serve as notice that the following entities: owner/operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company are not responsible for any damage to any vehicle that is brought into the event. As a condition to entering into this event with a vehicle, the entrant expressly waives all liability claims against all persons and entities involved with the event and releases all persons and entities involved with the event from any liability for damage to any vehicle that is brought into the event. Every person attending Luftgekühlt 12 with a vehicle (Entrants) acknowledges that the owner/operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company are extending a special privilege in allowing him, or her, to bring his, or her vehicle, onto the premises where the Luftgekühlt 12 event is being held. In consideration of the privilege to bring the vehicle onto the premises, every person responsible for a vehicle being brought onto the premises, for himself or herself and any personal representative, heirs, and next of kin, hereby acknowledges, agrees and represents the following:

To release, waive, discharge, and covenant not to sue the owner and operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company, its employees, and agents from all liability to me, my personal representative, heirs, and next of kin for any loss, theft, or damage, and any claim or demands therefore on account of injury to my property, including if caused by negligence or condition of premises or the negligence of the owner and operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company, and their employees, agents, volunteers, officers, trustees and directors, hereinafter designated releases.

To indemnify and save and hold harmless the owner and operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company from any loss, liability, theft, damage or cost that may incur due to Entrant bringing a vehicle, upon or about the premises whether caused by the negligence of the owner and operator of Luftgekühlt otherwise. Entrant agrees that if any claim or action for property damage is commenced against releases, Entrant shall defend, indemnify, and save harmless releases from any and all claims or causes of action by whomever or wherever made or presented for property damage.

Vehicles that enter the buildings for display must have no more than a 1/4 tank of fuel and ability for the battery to be disconnected. All Luftgekühlt 12 show cars are subject to inspection and verification by a Luftgekühlt team member.

That the owner/operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company does not guarantee the security of the property being brought onto the premises. All Entrants further acknowledge that there may be risks and dangers neither known by, nor reasonably foreseeable to, releasees. Entrants acknowledge that all of the risks and dangers, whether known or reasonably foreseeable or not, are included within this waiver and release. If the law in any controlling jurisdiction renders any part of this waiver unenforceable, the remainder of this waiver shall remain enforceable to the full extent of the law. All persons attending Luftgekühlt 12 with a vehicle (Entrants) acknowledge the above risks and liabilities. All persons attending Luftgekühlt 12 with a vehicle (Entrants) affirm that he or she had an opportunity to get the subject vehicle insured to cover all such risks with an insurance agent and/or insurer of their choice. All persons attending Luftgekühlt 12 with a vehicle (Entrants) acknowledge that the owner/operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company do not maintain insurance to cover their vehicle. All persons attending Luftgekühlt 12 with a vehicle (Entrants) agree that the owner and operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company and their agents, and employees will not be responsible for, and Entrant releases the owner and operator of Luftgekühlt, LLC and Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company, its agents, and employees from any and all liability for loss, theft, and/or damage to the vehicle and its contents.

By purchasing this ticket and entering Luftgekühlt 12, I understand that Air|Water or Luftgekühlt, LLC and its partners may photograph me, take motion pictures of me, take video footage of me, and/or make electronic sound recordings of me (herein referred to as “photographic or electronic reproductions”). I authorize the use of any such photographic or electronic reproductions of me for any purpose, including but not limited to, promotional and business development content, as may be deemed appropriate by Air|Water or Luftgekühlt. I understand that I may be identifiable from such photographic or electronic reproduction. I waive any right to royalties or other compensation arising from or related to the use of the photographic or electronic reproductions.

Luftgekühlt prohibits the following items from entering event premises: Alcoholic Beverages, Illegal Substances, Folding Chairs, Skates, Rollerblades, Bicycles, Tricycles, Skateboards, Ladders, Step Stools, Portable Tents, Ice Chests, Guns, Knives, Mace, Stun Guns, Glass Bottles, Hoverboards, Drones, RC Aircraft, Fireworks, Fire Pits. No solicitation or selling is allowed on event premises without explicit, written permission from Luftgekühlt, LLC.

While participating in events held or sponsored by Luftgekühlt, LLC, consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and/or wear face coverings to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Luftgekühlt has put in place preventative measures to reduce the spread of COVID-19. However, Luftgekühlt cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19. In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in Luftgekühlt events and/or other face to face fundraising activities. By attending Luftgekühlt 12, you certify that you do not fall into any of the following categories:

1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or

3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact Luftgekühlt at info@luftgekuhlt.com or Luftgekühlt.com if he/she experiences symptoms of COVID-19 within 14 days after participating or volunteering with Luftgekühlt.

I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with Air|Water or Luftgekühlt, LLC, and I willingly engage in Luftgekühlt 12 (the “Activity”).

I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST Luftgekühlt, LLC AND ITS AFFILIATED PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE ACTIVITY. ASSUMPTION OF THE RISK: I acknowledge and understand the following:

1. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;

2. I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and

3. I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

I acknowledge the health risks associated with the Activity, including but not limited to transient dizziness, lightheadedness, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the Activity, I will discontinue my participation immediately and seek appropriate medical attention. I DO HEREBY RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY CLAIM WHATSOEVER WHICH ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITY. As a participant, volunteer, or attendee, You recognize that your participation, involvement and/or attendance at any Luftgekühlt, LLC event or activity (“Activity”) is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing or participating in the Activity, You acknowledge and assume all risks and dangers associated with your participation and/or attendance at the Activity, and You agree that: (a) Luftgekühlt, LLC (b) the property or site owner of the Activity (Trilith Town Centre, LLC, Trilith Live, LLC and Georgia Theatre Company), and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities (subsections (a) through (c), collectively, the "Released Parties"), will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of your participation in, attendance at, and/or observation of the Activity, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties (collectively, the "Released Claims"). BY ATTENDING AND/OR PARTICIPATING IN THE ACTIVITY, YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
